GLA Advises EnerTech On US$ 20 Billion Green Hydrogen Project in Oman

GLA & Company acted on behalf of EnerTech, a subsidiary of the Kuwait Investment Authority-owned National Technology Enterprises Company and a Kuwait government-backed clean energy investor and developer, as one of the members of an international consortium developing an integrated green hydrogen mega project in the Sultanate of Oman (GEO Green Hydrogen Project), with investments worth more than USD $20 Billion.  The parties recently held the signing ceremony this month in Oman with great fanfare.

EnerTech signed the term sheet agreement in Oman with its consortium members Shell PLC, part of Shell Global, OQ, which is the Sultanate of Oman’s global integrated energy company, and InterContinental Energy, the leading dedicated green fuels developer.  The Project will consist of 25 gigawatts (GW) of renewable solar and wind energy at full capacity to produce millions of tons of zero-carbon green hydrogen per annum. Alex Saleh, Managing Partner, said “ We are proud that GLA is part of such a wonderful initiative and truly enjoy having a positive impact on EnerTech and the consortium as a whole”.

Senior Associate, Asad Ahmad, led the GLA team with Alex Saleh and with assistance from other team members.  Asad Ahmad commented on the transaction, “this initiative is novis and requires all parties involved to be forward thinking and flexible to ensure long term future success. Many other governments around the world will be studying this project with an aim to implement similar initiatives and contribute to the energy transition of the planet. It has been a pleasure working with my counterparts from Shell, OQ, Intercontinental, and Golden Wellspring”.

Alongside its consortium members, GLA & Co represented EnerTech in its negotiations with Hydrogen Oman SPC (Hydrom), a subsidiary of Energy Development Oman. The law firm continues to represent EnerTech in the underlying GEO Project agreements.

Senior Partner, Nader Al Awadhi, concluded that “this deal reflects GLA’s abilities to project its regional expertise across all jurisdictions in both the GCC and the wider MENA region.  Stay tuned as we are involved in a number of large deals throughout the Middle East with our strong Arab civil law skills and expertise”.
